Board authority & process

Who has to approve a program change, which process routes exist, and what each can and cannot do.

Avoid / caution

Not legal advice

This page summarizes public law and district policy. It does not conclude that anyone violated a law or policy. Talk to Kansas counsel about any specific situation.

Who approves a program change?

Policy ID says additions, deletions or alterations to the instructional program "shall be approved by the board," while Policies CE and CF delegate administrative duties and general supervision to the superintendent. The Board re-approved Policy ID on May 11, 2026. The Board action or delegation behind the 2026 change has not been found in the public records reviewed; see The Facts. 1 3 4 2

Policy IC says the Board considers the basic educational program annually and approves curricular offerings. Policy IJ contemplates administrative evaluation and recommendations to modify or eliminate programs. 5 6

The open questions are whether ending elementary and middle-school Chinese is a "deletion or alteration" under Policy ID; whether a recorded Board action already approved it, perhaps as part of a broader budget or plan; and whether the Board validly delegated this kind of decision.

Our reading

The district's fair response

It may point to delegated administrative authority, to evaluation duties under Policy IJ, or to an earlier Board approval broad enough to cover the change. It may also say the change will return to the Board before implementation. Policies have to be read together. 3 4 6

Process routes and what each can do

Route What it can produce What it does not do
Board agenda request and Open Forum Public review, Board direction, a pause, a transition plan, or restoration No member of the public can force an agenda item 7
Kansas Open Records Act (KORA) Existing records, delay explanations, fee discipline Does not restore instruction or require new analyses 8 9
Policy KN complaint A written determination; an unresolved curriculum complaint is reported to the Board Does not guarantee an outcome 10
Kansas Open Meetings Act (KOMA) Compliance remedies if evidence of a covered meeting appears Not established on the current record 11 12
Court action At most, likely a process ruling or narrow status-quo order A court is unlikely to order a particular curriculum

Process deadlines

  1. 3rd business day after receipt

Kansas Open Records Act response Verified

General rule for any records request: the district must act on it by the end of the third business day after receiving it. Full production may take longer if the response explains the delay and gives the earliest date records will be available. 8

  2. 10 school days after informal steps end

    Policy KN formal complaint Conditional

A general or curriculum complaint is filed in writing within 10 school days after the informal process concludes. Complaints against the superintendent follow a separate route (as soon as possible, within 20 days of awareness). 10

  3. 21 days after a specific meeting

Open-meetings (KOMA) voiding window for prosecutors Conditional

Only the Attorney General or a county or district attorney can ask a court to void a binding action taken at a meeting that did not substantially comply with the Open Meetings Act, and only within 21 days of that meeting. No such action or violation has been identified; neither the October 12 nor the October 14, 2026 agenda listed a Chinese-program action. Anyone with concrete evidence of a specific noncompliant meeting should consult counsel promptly. 13 14 15

Board meetings and agenda items

Policy BCBD says the superintendent and Board president compile the agenda, and other Board members may request items. The annotated agenda goes to members at least two calendar days before a regular meeting. That is an internal deadline, not a public posting deadline. 7

A Board special meeting can be called by the president or any three members jointly. 16 17 The agenda format may include "requests for hearings." 7 Parents can ask for a special meeting or a hearing but cannot compel one.

Policy BCBI governs public input. The Board does not have to debate speakers, and video or digital visual aids are not allowed. Policy BCBF says Robert's Rules of Order are not adopted, so there is no parliamentary right to force a reconsideration motion. 18 19

Records requests (KORA)

lets anyone request existing public records. Two requests are already pending; see records already requested before filing another.

Documented

Under the Kansas Open Records Act, a records request must be acted on by the end of the third business day after it is received. That is a deadline for a response (access, a denial, or a detailed explanation of the delay with the earliest date the records will be available), not necessarily for complete production. If access is denied, you can request a written statement citing the specific legal grounds. 8

The rules that matter when you file
  • KORA covers records that already exist when you ask. It does not require answers to questions, research, or creating new records. 9
  • Ask for existing records by category and date range, and ask for an itemized fee estimate before any work is done. 8 9
  • Fees may not exceed actual cost. If staff time will exceed five hours or $200, the district must try to discuss ways to reduce the cost. Answer that outreach by the third business day, or the request can be treated as withdrawn. 20 21
  • When part of a record is exempt, the district must release the rest. 22
  • Records made and kept by an individual Board member are excluded from the definition of a public record. District-held copies and agency systems need record-by-record analysis. 23

Open meetings (KOMA)

covers when Board discussions must be public. A "meeting" requires interactive discussion of Board business by a majority of the Board. Serial communications count only when they collectively involve a majority, share a common topic, and are intended to reach agreement on a matter needing binding action. One-way staff memos, separate non-interactive briefings, or a decision under previously delegated authority do not by themselves prove a meeting. 24 11 12

Complaints under Policy KN

Policy KN favors resolving complaints at the lowest level. A formal general complaint is due within 10 school days after informal procedures conclude. If a curriculum complaint is not resolved, the superintendent must report it to the Board at the next regular meeting. A complaint against the superintendent personally is a separate route with a different deadline. A disagreement over a curriculum decision does not by itself justify accusing the superintendent. 10

Documented

Kansas's school-closing hearing and petition procedure applies to closing a school "building." Ending a program while the school stays open is not the same statutory event. 25

Why contract, reliance, injunction and discrimination theories are weak
  • Contract: this would need a definite, authorized promise with acceptance and consideration, and no reservation allowing program changes. The public pages say the district "plans for" a K–12 commitment. That is evidence of what was represented, not a proven contract. 26 27
  • Promissory estoppel (reliance): this depends heavily on the facts. Kansas courts limit estoppel against public bodies, and reliance damages are more plausible than forcing a program to continue. 28 29 30
  • Injunction: this requires likely success, irreparable harm and a favorable balance of harms. 31 Implementation does not begin until 2027–28, and Kansas law gives the Board authority to prescribe courses of study. 17
  • Discrimination or constitutional claims: no reviewed fact supports them. Cancelling a Chinese program does not by itself show discriminatory intent.
